There are many people that are conflicted in this country on how to properly deal with the issue of drugs and how they should be handled. There are some people that firmly believe that legalizing all drugs will solve a lot of our country’s problems. The advocates for legalizing drugs believe that this would benefit everyone by making our streets and homes much safer due to the fact that drug addicts will do anything for their next â€Å"fix†. Drug prices increase with the restriction of drugs by law enforcement and the addicts are desperate for money and will commit a string of muggings, burglary of homes and cars or even murder to finance their habits. The higher the price of their drug the more they will need to steal to buy their supply. Drug dealers are also in possession of very â€Å"valuable† property and are a big target for assaults and even murder to steal the dealers money or drugs that they have on them at the time. The drug gangs also compete over areas to peddle their drugs with other drug dealers which lead to violence and murder between the dealers. If drugs are legalized then the drug prices will plummet and there will be no need for the addicts to commit crimes or murder to get ahold of their drugs. The drug dealers on the streets will be forced out of work by the retail marketing of drugs by reputable and well known retailers. Developmental psychologists tell us that development is caused by two very extensive intermingling factors: heredity or nature, and environment or nurture. Often determining the demarcation line between these two factors, which directly or indirectly influences our biological and psychological constitution, is not an easy task. Nature speaks of the transmission of traits from parents to offspring through the genes which is universally known as heredity. Discussion In general, it can be argued that all behavior reflects the influence of both nature and nurture. All organisms acquire or inherit a range of structures that set the stage for certain behaviors. Yet environmental influence such as nutrition and learning also help decide whether or not genetically possible behaviors will be displayed. The genius of such creative writers as C.S. Lewis or Stephen King may never appear should they have been reared in less fortunate circumstances without the privilege or opportunity of even writing and reading. Nurture especially during the early stages in the life span influences some of the arenas of human existence. The best illustration to this is in the aspect of intelligence. Many studies have been conducted to emphasize the role of environment and this is illustrated in the areas of research where scientists try to manipulate the initial milieu around which many young children are in jeopardy of developing poor intellectual functioning. These researches actually put stress or accentuate the preventive aspect instead of addressing the interventions that may be applied later on. A lot of families from below the poverty line reasonably, are not able to afford their children a cognitively motivating atmosphere. For this reason, majority of these children are even expected to perform below their capacity. It is arguably to the side of nurture in instances that intellectual functioning is compromised when the environment component is not maximized. Hence the reason that some of the government’s popular programs to address the problem are in place. They include such services as Head Start, which are confirmed effective strategies in developing the child’s intellectual capability (Ramey, 1989 in Halonen and Santrock, 1996, p. 280). Despite some of the controversies that surround the efficacy of the â€Å"No Child Left Behind Act† spearheaded by President George W. Bush, the rationale following this public policy is the fact that children coming from inner cities and minority groups will be provided ample opportunities for cognitive development via government funding. Schools that do not perform at par with â€Å"productive ones† will be evaluated and funding consequently is affected. This raises up the standard of the schools especially their teachers. Whether this is fail-safe or not, is not the question here. However, this is a clear illustration that without any environmental intervention, children left to themselves may not develop competence or achieve their potential. Another evidence that point to the effect of environment on human development especially during the early years is based on observations or studies on parental abuse of children. According to research, the growth and development of a child is modified incessantly by the influences in the environment. The fact that maltreatment by parents over their children account for the vast differences of performance of school age children and many of the resulting disorders or maladjustment problems that are frequent problems encountered by educators, substantiates the claims of nurture or environmental influence (www.ipce.info/library_3/files/glaser/glaser_2.htm). Early childhood environment impacts the child’s cognitive ability is also shown in a study on the effects of nutrition in infancy and later cognition. Nutrients as provided by formula or any other supplement affect brain development significantly.   The study supports the hypothesis that optimum nutrition in infancy â€Å"has significant consequences for cognitive development (Lucas, 1998). Conclusion Nurture is perhaps the strongest alibi any person attributes to whenever things turn out not as good as they want them to be. We often make justifications why we tend to be mediocre; â€Å"because my parents did not try their very best to train me and provide for all that I need,† is our typical rejoinder. To what extent is this true, and where does the line end when it comes to personal responsibility, genetic predispositions, or the responsibility and accountability of people who exert immense influence on us? The argument postulated in this paper is not so much as â€Å"drawing the line† in as much as it has evidently proven the great impact of nurture on personality and/or human development in general. This paper pointed out exactly, that many of individual decisions and government policies are responses to the effects of environment to early human development, thus proving the hypothesis correct. Parental abuse and neglect have been issues in learning because these are factors that are vital to the child’s overall performance and normal functioning as they operate as kids and later as adults in the real world. This is also true with nutritional status of children in their growing years. Several studies have proven the effects of these factors that they are consciously observed among the educated parents; as much as possible, many actively pursue in avoiding the drastic effects of either deficiency. Indeed, the environmental changes that are constantly influencing children in their early stages are established in the scientific disciplines; this despite the many arguments to the contrary. The most basic dispute is the separation of church and state. As reiterated in a 1962 Supreme Court ruling in the case of Eagel v. Vitale, the court ruled that public schools were not empowered to condone school prayer and in fact that school prayer was unconstitutional(Dierenfield,2007). The case was brought about by families of public school students who complained that the voluntary prayer, â€Å"Almighty God,† was a contradiction to their beliefs. The prayer went simply, â€Å"Almighty God, we acknowledge our dependence upon thee, and we beg thy blessings upon us, our parents, our teacher, and our country. Amen. †(Murray,2010) The complaint argued that beginning the school day with this prayer violated the Establishment Clause of the First Amendment to the U. S. Constitution which states, â€Å"Congress shall make no law respecting an establishment of religion. † The constitutionality of the prayer had been upheld the N. Y. State Appeasl (Smith,1987). Not ironically perhaps because the prayer had been written and approved by the N. Y. Board of Regents. It ruled the opinion of the Supreme Court was that a government authorized prayer could not be made mandatory to be recited in a public school. The Court further went on to reinstate how important the Separation of Church and State is. They went on to explain that prayer is a religious activity and thus violated the establishment clause. Many believe that since school prayer has been banned, crime has increased, family values have deteriorated, and some zealots even predict that it is the forerunner to Armageddon, as America has lost its soul. Some believe that banning prayer actually deprives religious freedom as guaranteed in the Constitution. By prohibiting prayer it in turn promotes Non-Religion. That is to say without prayer in school it discourages a child from believing in any religion and gives a sense that praying at all is bad. On the other side, those against prayer in school feel that if it were allowed, religion would be forced upon students. They feel that school is there strictly for education and religion should not be part of it. Prayer promots emotional feelings and can give rise to religious discrimination of these opposing beliefs. Some go as far to say that prayer in school wastes time better spent focused on studies. Prayers are part of values learned at home and as such should remain there. Those against prayer will also say that schools allow enough free time for any religious observance. As the case against prayer in public school continues to be upheld by the courts, I have to admit that the side against prayer has the more logical argument. The Constitution guarantees a citizen the right to private prayer, but it does not force others to listen if they chose not to. I agree with the statement, â€Å"State supported prayer is not ‘Free Exercise’ its ‘Forced Religion. ’†(Dierenfield,2007) And that is why it is prohibited. Another fact I take credence in is that according to the U. S. Census church membership remained constant since 1960, before prayer in public school was banned. True morals in this country have declined since the Supreme Courts originally ruled, but I owe that more to the decline of Family Values. Due in part to changed in family dynamics as there are more and more single parents, as well as both parents being forced to work. The question of school prayer in public schools is indeed a philosophical one. I truly believe this debate will be never-ending. Just as people debate the existence of a God; there will always be more questions than answers to the issue. Exactly how prayer in school ultimately affects students is subject to interpretation. The matter cannot be judged or determined as a whole because young individual minds are a stake here. In my opinion I believe it is all the more important that individual rights and free thinking must be the main objective in teaching our children. We must continue to teach, not preach religion to young minds. Expose them to all the different cultures and religious beliefs there are. Show them that be it Christianity, Judaism, Muslim or any other religion, all promote goodwill and love. All are there for them to embrace and choose if they so desire. Whenever that happened, people would say that the old house must have been a bakery or, at the very least, the former home of a fabulous baker. Sometimes, the neighbors would hear the sound of music and laughter coming from the empty house as if there was a wonderful party in full swing. But even the friendliest spirits are scary and no one ever actually went inside the house. The trick is making friends with the ghosts, learning to get along with them. † So the man went to the Pastor of the local church and told him his problem. The shop is relying on an exemption clause.   Customer A is likely to have a remedy against the shop under schedule 3 of the Unfair Terms in Consumer Contracts Regulations (1999) which disallows a business to exclude a consumer’s legal rights.   In this instance, customer A may seek provision under the Sale of Goods Act 1979 s 14 (2) (goods must be of satisfactory quality) as amended by the Sale of Goods Act 1994 if the shop does not assist her. 2.   Customer B may be able to rely on undue influence, the main case being National Westminster Bank v Morgan where it was held the claimant must not suffer from manifest disadvantage.   Undue influence simply means unfair pressure on a party when forming a contract.   The shop may argue there was no special relationship between the parties, in which case it is for customer B to prove this (Williams v Bayley).   Following the decision in Lloyds Bank v Bundy, the question may be whether there was ‘inequality of bargaining strength’ the shop acted as an agency for the HP financers.   In this case, the creditor (financers) may be unable to enforce the contract against customer B (Kingsnorth Trust v Bell) if customer B can successfully plea undue influence then the contract may be rendered voidable (set aside). 3.   In relation to customer C, she may be able to rely on the Sale of Goods Act 1979 as amended by the Sale and Supply of Goods Act 1994, which states under s.13, that the goods must be as described (see: Beale v Taylor).   There must be a reliance on the description of goods as decided in: Grant v Australian Knitting Mills Ltd, but in this instance the customer is entitled to a remedy against the shop. 4.   Customer D is seeking to bring a complaint for fraudulent misrepresentation under the Misrepresentation Act 1967.   Stating that the childminders were qualified is a false statement of fact (Bisset v Wilkinson).   Defined in Derry v Peek, fraudulent misrepresentation is a statement where there are several factors, one of which is a ‘reckless statement made without caring whether it was true or not’.   In this instance, the shop is liable for all damages, including all loss, to the customer (Smith New Court Securities v Scrimgeour Vickers).   5. Neighbours are seeking to complain over a private nuisance. It can be defined as: â€Å"continuous, unlawful and indirect interference with a person’s enjoyment of land†Ã‚   Balance must be stuck between conflicting interests, namely the shop needing its deliveries and the neighbours’ peace in the morning.   Has the duration being continuous? (Bolton v Stone)   The shop being aware of the problem, if it fails to address the issue, then it may be liable for nuisance (Leakey v National Trust). 6.   The shop has a duty of care under the Occupier’s Liability Act 1957, s 2 (1) towards visitors, in this case invitees to the shop (s. 1 (2)).   The shop must take ‘reasonable steps to inform a visitor that an area is out of bounds.   It did so in this case, with the notice on the door.  Ã‚   Under s. 2 (3) (a) of the OLA 1957, the shop must be prepared for children to be less careful than an adult.   However, the shop is entitled to be assured that the behaviour of a young child should be supervised by an adult (Phipps v Rochester Corporation).   Therefore, this part of the claim may fail since the mother did not keep her child under supervision. In relation to her claim for nervous shock, there is a 3 stage test as outlined in Alcock v Chief Constable of South Yorkshire Police, namely: a). Was the mother in sufficient proximate time and space to the incident?   b) There must be close ties of love and affection to the victim c) The claimant must have seen or heard the incident or its immediate aftermath.   As all these answers are in the affirmative, then it is likely this part of the claim may be successful against the store. 7.   The shop is liable for injury to F under the Employer’s Liability Act 1969, s1. F is no longer required to pursue the manufacturer as the shop has informed her, although she may do so if she wishes.   F (employee) must show: a) That the defect in the equipment caused the accident and b) That the defect was due to a fault in the manufacture. In this part, the employer is liable directly to F. With F’s claims for bullying, the shop is liable under vicarious liability, since this is a tort by an employee acting in the course of their employment.   A noted case for this was outlined in Jones v Tower Boot Co 8.   An advertisement is an invitation to treat, where the customer makes an offer to buy (Partridge v Crittenden).   There may only be revocation of an offer where response is made to an invitation to treat (Payne v Cave).   In this case the customer accepted the terms of the offer and is entitled to the goods as stated (Lefkowitz v Great Minneapolis Surplus Stores).   9. The shop is liable under the Consumer Protection Act 1987.   The fact that H’s sister did not make the contract is irrelevant as the case of Stennett v Hancock illustrated that a duty of care is owed to a person receiving presents from the original buyer (H). Under s. 2 (1) of the CPA 1987, the supplier (shop) is liable, since the customer cannot identify or contact the manufacturer.   10.   The shop owes K a duty of care as outlined in the ‘neighbour’ principle of Donoghue v Stevenson.   To prove negligence, there must have been a duty, that duty was breached and causation. Therefore, the shop is negligent in this case.   Also, K may have a claim under the Consumer Protection Act 1987 which places strict liability on anyone in the distribution food chain where a consumer suffers harm. 11.   This contract is frustrated.   In the case of Taylor v Caldwell, it was determined that where a contract depends on a given thing (in this case 100 copper saucepans), and there is impossibility of performance of the contract, then the performance should be excused.   Both parties are discharged from further performance in this case as the supplier cannot supply the order requested. 12.   Part payment of a debt can never be satisfaction for the whole payment as outlined in Pinnel’s Case (1602).   This has since been confirmed in Foakes v Beer and Re Selectmove.   Further, if the money is unable to be recovered at a later date, the doctrine of promissory estoppel applies where further rights to recover the remaining sum will be extinguished (High Trees case) 13.   This is a case of pure economic loss.   The negligent driver does not owe a duty of care to the shop as there was no damage to the shop’s property (Spartan Steel v Martin).   Based on policy guidelines, the loss of profit to the shop is ‘non-recoverable’ to avoid the driver from a ‘crushing liability’. 14.   This is a negligent statement on the part of the accountants.   In Hedley Byrne v Heller, the House of Lords held that a ‘high degree of proximity or closeness of relationship is required, and for liability to arise, a special relationship has to be shown between the maker of the statement and the person who relied on it.’   XYZ should be able to sue the accountants. Collective Male Initiation Rituals of the Sambia   Ã‚  Ã‚  Ã‚  Ã‚  The transition of a boy to a man is very important to the Sambia, of New Guinea. This transition consists of an initiation ritual, which has 6 stages and takes between 13 and 20 years to complete. The first 3 stages are collectively focused, which I will discuss, and stages 4 through 6 are individually focused. This ritual helps to introduce the boys to male society, prepare them for adult responsibilities and is used to transmit culture (Nanda 2002: 132). The beliefs of the Sambia show a â€Å"warriors conception of manhood where men should be strong, brave, and unyielding in the pursuit of all tasks† (Herdt 1981: 50). The first stage of initiation is called Moku and occurs between the ages of 7 and 10. The second stage is called Imbutuand occurs between the ages of 10 and 13. The third stage is called Ipmangwi and occurs between the ages of 14 and 16.   Ã‚  Ã‚  Ã‚  Ã‚  In the first stage of initiation the boys are taken from their mothers homes and taken to live at the men’s clubhouse. Here boys are given a ritual sponsor who is usually in the third or forth stage of initiation (Herdt 1981: 55). Early in the first stage is the stretching right. â€Å"The stretching rites are the initial stimulus to spur masculinity† (Herdt 1981: 223). In the stretching rites the boys are carried off into the woods by their ritual sponsor and sticks or switches are rubbed against the bodies of groups of boys by the elder males. The boy’s skin is rubbed and perforated. This is said to remove â€Å"sweat and the fine down of the boys cheeks, arms and legs† (Herdt 1981: 222) which are contaminants caused by close contact with their mothers. After this dangerous ritual their sponsor must carry the boys back to the men’s clubhouse.   Ã‚  Ã‚  Ã‚  Ã‚  One of the most important rituals in the first stage initiation is nose bleeding. This act is the most painful preformed on the initiates (Herdt 1981: 224). In this rite sharp blades of grass are stuck up the nose until it bleeds. This is done to remove any contaminated blood that is caused from extended contact with the boy’s mother (Herdt 1981: 223). This purifies the boys and enables them to move on to rites that will strengthen them.   Ã‚  Ã‚  Ã‚  Ã‚  After stretching and nose bleeding the initiate is given the ingestive rights.

And since its production begun a century ago, there are jingles of Coke that are still remembered now like â€Å"When the Holidays Come Along†(with the lyrics, ‘whenever there’s a coke there’s always a fun†¦), â€Å"The Bee Gees Coke Commercial†, â€Å"Have a Coke and Smile† (produced on 1981) and a very recent commercial aired last year, â€Å"The Coca-Cola Happiness Factory†. Mr. J. Frank Harrison III, a descendant of Mr. Harrison way back in 1902,   is currently the Chief Executive Officer, Chairman of Executive Committee and Chairman of Finance Committee of CCBCC.   Also, Mr. Steven D. Westphal acts as the Chief Finance Officer and joins the executive committee of the company. Moreover, Coca Cola Enterprises Incorporated shares in owning CCBCC and is said to have 1000 shares as of August 2007. Under the Beverage – Soft Drinks Industry, CCBCC is the top grosser on stocks among Pepsi Company Inc., Cadbury Schweppes Americas Beverages, Groupe Danone World Water Division, and other companies providing the same product as of the present. As of August 31, 2007, CCBCC sells Coke at an average of $58.67. From the recent quarterly reports of the company, it is stated that it has a net income of $11.7 million as of July 1 2007. This is higher than the calculated quarterly net income of April 2007 which was $4.7 million, more than a hundred percent increase on net income. The repots for the stockholders also said that there is a one percent increase on the net sales of the product that was from the decrease in the selling price of bottles/cans. Also, the charts and graphs presented for the evaluation of the sales and production of Coke on July 2007 stated that it has increased its selling price compared to the past months. Since there are still products emerging from this company and their bottling capacities are of good quality (as they claim it), I think that in the future Coca-Cola Bottling Company Consolidated will still be a big influence in the Food Industry, especially in the beverage – soft drinks sections.   By looking on the reports passed to the stockholders (which I think Coca-Cola Enterprises Inc. owns), it will have a progress for the years ahead bearing the quarterly increases on the incomes and the people who patronizes coke. Constant observation and evaluation of the company’s performance, the improvements and modifications for the product can be done for a more successful path in the economy.   Indeed this product will still be a boom for the next generations.
